Adjudication\nis still the default option, as the parties to the contract are legally obliged\nto have access to this method for resolving their dispute, however, the\ncontract advocates that the parties to the contract choose mediation as an initial\nstep in the process, as mediation can be less expensive than other methods, and\nis therefore encouraged by the courts. \u003c\/p\u003e\u003c\/li\u003e\n\u003cli\u003e\u003cp\u003eThe \u003cb\u003eProgramme\u003c\/b\u003e\noptional item has been simplified. The contract have retained the requirement\nfor a contractor to indicate the activities they will carry out to complete the\nworks, including the start and finish times of each activity and the\nrelationship of each activity to the others. However, the obligation on the contractor\nto submit a Programme prior to the commencement of the works, and any financial\npenalties for not doing so (perceived as too confrontational), have been\nremoved. \u003c\/p\u003e\u003c\/li\u003e\n\u003cli\u003e\u003cp\u003eThe \u003cb\u003eContractor\nDesign\u003c\/b\u003e optional item has been retained, so that, if it is agreed that the contractor\nis to design part of the Works, a detailed and accurate description can be provided\nof the parts that the contractor will design. However, this optional item now\nalso allows a level of professional indemnity insurance to be specified.\u003c\/p\u003e\u003c\/li\u003e\n\u003cli\u003e\u003cp\u003eThe \u003cb\u003eRequired\nSpecialists\u003c\/b\u003e optional item has been amended so that while clients can still\nrequest that specific subcontractors and suppliers be used for parts of the\nWorks, details of those parts of the works are now to be identified at the\ntender stage and listed in the Contract Documents.\u003c\/p\u003e\u003c\/li\u003e\n\u003cli\u003e\n\u003cp\u003eThe contract now includes a \u003cb\u003eContract Checklist\u003c\/b\u003e which both parties should review and answer\n‘yes’ to the questions provided before signing the contract.
